1. Acceptance of Terms
By accessing the SmokeTally.com and smokeloopintercept.com web architectures, downloading our printable digital ledgers, or using our associated software applications (including the Smoke Loop Intercept mobile application), you agree to be bound by these Terms of Service. If you do not agree, you must immediately cease using our digital assets and infrastructure.
2. Intellectual Property Rights
All content deployed across this ecosystem—including mechanical tracking frameworks, baseline audit ledgers, software code, thermodynamic simulations, text, and graphical assets—is the exclusive human-engineered intellectual property of SmokeTally. You are granted a limited, non-transferable license to access and utilize these materials for personal, non-commercial purposes. You may not distribute, modify, resell, or reverse-engineer our software, algorithms, or content without explicit written consent.
3. Digital Sales and Refund Policy
All transactions for digital products, memberships, or software access keys are processed securely via external platform ecosystems (including, but not limited to, Google Play Billing, the Amazon Appstore, and secure third-party web gateways). Due to the immediate, downloadable nature of digital assets and software access, all sales are considered final unless explicitly mandated otherwise by the external merchant’s localized terms or regional consumer protection laws.
4. Absolute System Disclaimer
SmokeTally provides mechanical tracking frameworks and systemic software tools for informational and self-reflective purposes only. Our systems track performance patterns and behavioral metrics; they do not constitute and are not a substitute for professional medical, psychological, or psychiatric care. We make no guarantees regarding specific physiological outcomes, recovery speeds, or lifestyle adjustments. The Operator assumes full, independent responsibility and liability for how they interpret, implement, and execute the frameworks presented across our architecture.
5. Termination of Access
We reserve the right to suspend, revoke, or terminate your access to our software tools, mobile applications, or automated communication funnels at our sole discretion, without notice, if we detect fraudulent activity, systematic data scraping, or any violation of these intellectual property terms.
6. Governing Law
These terms are governed by and construed in accordance with applicable cross-border digital commerce frameworks. Any disputes arising out of these terms will be settled through standard digital arbitration channels.
