Smoketally.com's Privacy Policy
Effective Date: September 16, 2026
This Privacy Policy governs the manner in which SmokeTally
(“we,” “our,” or “us”) accesses, collects, uses, maintains, retains, and
discloses information collected from users of our digital properties. This
policy explicitly applies to SmokeTally.com web architecture, the downloadable
ledgers, the Smoke Loop
Intercept mobile application, our automated communication funnels, and any
future software interfaces or mobile applications deployed under the SmokeTally
ecosystem.
1. Information We Access, Collect, and Process
We collect only the essential data required to deliver,
secure, personalize, and improve our mechanical tracking frameworks and
software products. This includes:
- Voluntary
Personal Information: Names and email addresses submitted when
subscribing to our hubs, downloading baseline audit ledgers, or creating
an account within our applications.
- Habit
and Behavioral Profiling Data: To generate personalized operational
plans, calculate thermodynamic metrics, and adapt our reduction algorithms
(such as printable smoke ledgers
within Smoke Loop Intercept, etc.), we collect specific demographic
and habit-related data during onboarding.
- Mandatory
Fields: To ensure our core algorithms function, users may be required
to input operational metrics such as years of smoking, daily consumption
counts, average sleep hours (to calculate biological recovery windows),
and localized currency parameters.
- Optional
Fields: Age and Sex/Gender are completely voluntary. Users may leave
these fields blank or select “Don't Tell” without restricting access to
our systems.
- Data
Protection: This profiling data is kept strictly confidential and is
used solely to calibrate your personal biological recovery architecture
within the application or ledger ecosystem.
- Transactional
and Financial Data: We do not process or store raw credit card
numbers. We handle purchases, subscriptions, and financial transactions exclusively
through secure, platform-integrated payment systems (such as Google
Play Billing and Amazon Appstore services) or other encrypted,
industry-standard third-party payment gateways. We receive only
generalized purchase history and encrypted confirmation tokens required
for account provisioning.
- Technical
and Device Data: Standard tracking parameters, including IP addresses,
mobile device IDs, operating system versions, crash logs, and usage
analytics. We collect this data through systems like Google Analytics
(GA4) to ensure application stability, troubleshoot errors, and
optimize cross-platform performance.
2. How We Use Your Data
We process your data under the legal bases of fulfilling our
contract with you, your explicit consent, and our legitimate business
interests. We use your data to:
- Personalize
System Functionality: Calculate biological benchmarks, pacing gaps,
and adaptive reduction caps based specifically on your behavioral history.
- Account
Management: Create, manage, and authenticate your software access keys
across web and mobile environments.
- Communication:
Deliver automated educational updates, architectural blueprint emails, and
relevant systems updates using only your voluntary contact information.
- Strict
Behavioral Data Isolation: Your habit and behavioral profiling data is
strictly isolated and is never used for advertising profiling.
- No
Data Selling: We do not sell, rent, or lease your personal data,
health/behavioral metrics, or email profile to third-party data brokers.
3. Data Retention and Deletion Policy
We enforce strict data retention practices to ensure your
information is not held longer than necessary:
- Retention
Period: We retain your personal and behavioral data only for as long
as your account is active, or as strictly necessary to fulfill the
operational purposes outlined in this policy. Technical logs and analytics
data are routinely purged and retained for no longer than 14 months.
- Account
and Data Deletion: You have the explicit right to request the complete
deletion of your account and all associated personal and behavioral data
at any time.
- How
to Request Deletion: To initiate full data erasure, please utilize the
Contact Us page on our website or email our support infrastructure
directly with the subject line “Data Deletion Request.” Upon verification,
your account and associated personal data will be permanently deleted from
our active databases within 30 days.
- Legal
Exceptions: We may retain specific transactional records for a longer
period strictly if mandated by tax laws, accounting regulations, or formal
legal obligations.
4. Data Security and Encryption
We implement industry-standard security measures to protect
your personal and behavioral data. All data transmitted between your device and
our servers (including your onboarding profile, smoking history, and usage
metrics) is encrypted in transit using secure cryptographic protocols
(HTTPS/TLS). Access to your data is strictly limited to authorized personnel
and systems required to operate the infrastructure.
5. App-Specific Data Handling and Third-Party SDKs
Our web and mobile applications utilize third-party Software
Development Kits (SDKs) and analytics services (including Google services) to
monitor performance, track crash reports, and analyze usage trends. These
third-party processors are bound by strict data processing agreements, are
prohibited from using your data for independent purposes, and do not have
access to your health and behavioral profiling data for their own secondary
use.
6. Your Global Privacy Rights (GDPR, CCPA, and CPRA)
Depending on your jurisdiction of residence, you are
entitled to specific global privacy rights:
- Right
to Access and Portability: You may request a summary or a digital copy
of the personal data we hold about you.
- Right
to Rectification: You may request corrections to any inaccurate or
incomplete data.
- Right
to Erasure (Right to be Forgotten): You may request the deletion of
your personal data as outlined in Section 3.
- Right
to Withdraw Consent / Opt-Out: You may opt out of our email
communication at any time by clicking the “Unsubscribe” link located at
the bottom of our broadcasts.
7. Data Sharing and Legal Disclosures
We will only share your information with external parties
under the following circumstances:
- With
verified service providers (e.g., secure email hosting, cloud
infrastructure) required to operate our software.
- If
explicitly required to do so by law, a court order, or a formal legal
subpoena during statutory regulatory audits.
8. Disclaimers and Limitation of Liability
- No
Professional/Medical Advice: Content within our applications, ledgers, and
communications is for educational, systemic, and self-reflective purposes
only. It does not constitute medical, psychological, psychiatric, legal,
or formal financial advice. Operators must consult qualified professionals
regarding any biological or psychological conditions.
- Third-Party
Platforms: We utilize external ecosystems for distribution and payment
processing (including, but not limited to, Google Play, Amazon Appstore,
and third-party web gateways). We do not control their independent privacy
systems or data retention policies.
- Limitation
of Liability: To the maximum extent permitted by applicable law, our
total liability is strictly capped at the amount you actually paid for the
digital product or service in question.
